1. Introduction and acceptance
These general Terms (hereinafter, «Terms») govern access to and use of the live shopping platform operated by MYRENTIX SOLUTIONS S.L («Krofter», «the Platform», «we»). By registering or using the Platform you fully accept these Terms, together with the Privacy Policy, the Cookies Policy, the Conditions of sale and, where applicable, the specific Terms for sellers.
If you do not agree with any part of these Terms, you must not use the Platform.
2. Description of the service
Krofter is an e-commerce platform that connects sellers with buyers and enables the sale of products live (through auctions, flash sales, slot raffles and permanent catalogue). Krofter is neither the seller nor the owner of the products published: it acts as an information society service provider and as a technical intermediary between the parties.
3. Registration and user account
- To use the Platform as a buyer or seller you must register by providing truthful, up-to-date and complete data. You assume responsibility for the accuracy of the information provided.
- You must be of legal age and have legal capacity to enter into contracts.
- You are responsible for the confidentiality of your password and for all activity carried out from your account. You must notify us immediately of any unauthorised access.
- Only one account per person is allowed. Creating multiple accounts to evade suspensions, penalties or limitations is grounds for immediate closure without the right to a refund.
4. Rules of use
You undertake to make lawful use of the Platform. In particular, the following is prohibited:
- Publishing illegal, counterfeit, stolen or dangerous products, or products that infringe intellectual property rights.
- Making fraudulent bids, manipulating auctions, using mule accounts or bidding without a genuine intention to buy.
- Communicating in an offensive, threatening or discriminatory way, or posting content that constitutes harassment or spam in the chats.
- Circumventing the Platform's payment, commission or shipping payment functions ("off-platform" sales of products seen on Krofter).
- Carrying out scraping, reverse engineering, denial-of-service attacks or any action that jeopardises technical availability.
Krofter may suspend or cancel accounts that breach these rules, without prejudice to any applicable legal action.
5. Services and commissions
Registration is free. The main costs of use are:
- For buyers: product price, Buyer Protection surcharge and shipping cost. All amounts are shown before confirming the order. The full breakdown is in the Help Centre — «Fees and charges» section.
- For sellers: commission on sales (1 % to 1.5 % depending on position in the monthly league) and commission on subscriptions (20 %). Krofter absorbs the Stripe fees on product sales. More detail in the Terms for sellers.
Krofter may change its commissions with a minimum notice of 30 days, notifying the affected sellers by email.
6. Contracting between buyer and seller
The sale contract is entered into directly between the buyer and the seller listing the product. Krofter acts as an intermediary and as a provider of payment and logistics services. The Conditions of sale detail the buyer's rights regarding withdrawal, guarantees, returns and dispute resolution.
Some content (auctions and flash sales) constitutes personalised or fixed-term contracts and may therefore be excluded from the right of withdrawal provided for in art. 103 of the TRLGDCU, as set out in the Conditions of sale.
7. Service availability
Krofter makes reasonable efforts to ensure the availability of the service 24/7 but does not guarantee uninterrupted availability. Technical downtime may occur for maintenance or due to causes beyond Krofter's control. Should a technical failure affect an ongoing auction, Krofter reserves the right to cancel or restart it.
8. Limitation of liability
To the extent permitted by law, Krofter shall not be liable for:
- Indirect damages, loss of profit or loss of opportunity arising from the use of the Platform.
- The conduct of other users, except where there is negligence by Krofter in moderation or mediation.
- Errors or omissions in the content published by sellers (descriptions, photographs, declared dimensions).
- Carrier delays, except as expressly covered by the Buyer Protection.
In any case, Krofter's aggregate liability towards a user for incidents on the Platform shall be limited to the amount actually invoiced to that user in the 12 months prior to the event, except in cases of wilful misconduct or gross negligence or where consumer regulations establish a higher minimum.
9. Term and termination
The relationship is of indefinite duration. You can close your account at any time from Settings → «Delete account». Krofter may suspend or cancel your account with reasonable notice, except in the event of serious breach, fraud, risk to third parties or a request from a competent authority, in which case the suspension may be immediate.
10. Amendments
Krofter may update these Terms to reflect legal, functional or business model changes. We will inform you by email or via the Platform itself with a minimum notice of 15 days. If you continue using the Platform after that period, you will be deemed to accept the new version.
11. Notices and contact
Any communication to Krofter may be sent to soporte@krofter.live. Krofter will communicate with you through the email associated with your account and, where applicable, via in-app or push notifications.
12. Governing law and dispute resolution
These Terms are governed by Spanish law. Consumers have the right to submit any dispute to the courts of their place of residence. They may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
