1. Scope of application
These Terms supplement the general Terms of the Platform and are binding on all users who use Krofter to publish products and broadcast live content for the purpose of selling them (hereinafter, «Sellers»). In the event of any discrepancy with the general Terms, these Terms prevail, as they constitute special regulation of the seller role.
2. Requirements to sell
- Being of legal age (18 years) and having legal capacity to enter into a contract.
- Identity verification via KYC (Didit): document, liveness check and tax details.
- Active and verified Stripe Connect account, with a linked bank account for payouts.
- Compliance with applicable tax obligations (registration as self-employed or as a company when the activity exceeds the regularity threshold).
- Express acceptance of these Conditions and of the general Terms.
3. Platform commissions
- Products: base commission of 1.5 % on the gross sale price (VAT included). Sellers who make it into the Top 3 of the monthly league enjoy a discount: Top 1 → 1 %; Top 2 → 1.25 %; Top 3 → 1.35 %.
- Fan subscriptions: flat commission of 20 % on each monthly fee, with no discount for league position.
- Cancellations for missing the shipping deadline: from the 3rd cancellation onwards, a penalty of 8% of the gross price of the cancelled lot, deducted from your Stripe Connect balance.
Krofter absorbs the Stripe fees on product sales. The full breakdown of the fee model is available in the Help Centre, «Fees and charges» section.
4. Seller warranties and representations
By listing a product on the Platform, the seller expressly warrants that:
- The published product data (size, material, brand, condition, authenticity, dimensions, weight, number of available units, etc.) are correct, truthful and not misleading.
- The product is free from defects in materials, workmanship and manufacturing beyond those explicitly stated in the description.
- The product complies with all applicable regulations (labelling, CE marking, toy/cosmetics safety, REACH, etc.) and can be legally sold through the Platform.
- The product is not counterfeit, does not infringe third-party intellectual or industrial property rights and, in the case of a registered trademark, the seller holds the chain of acquisition proving its lawful origin.
- The seller owns the product or has the owner's authorisation to sell it, and has legal capacity to enter into the sale contract.
In addition, the seller assumes the following operational obligations:
- Meet the maximum deadline of 5 calendar days to prepare the package and generate the label after each live close or order.
- Comply with the legal guarantee of conformity applicable in the buyer's country (Directive (EU) 2019/771 and national transposition rules), being personally liable to the buyer for the conformity of the product.
- To clearly publish their returns policy when it exceeds the legal minimums and to honour it.
- To participate in good faith in dispute mediation processes. Repeated failure to respond will be deemed acceptance of the buyer's claim.
- Comply with their own tax obligations (tax registration, issuing and reporting invoices, paying the VAT charged).
- Not to make sales outside the Platform of products displayed in Krofter live streams in order to avoid commissions or protections. This conduct is considered a serious breach.
The publication of illegal, counterfeit, stolen, dangerous or perishable products without adequate preservation, or products whose sale requires special licences or authorisations that the seller does not hold (medicines, weapons, alcohol to minors, protected species, etc.), is expressly prohibited. Breach will entitle Krofter to remove the content and cancel the account immediately.
5. Cancellations and penalties policy
A cancellation occurs when the seller does not generate the shipping label within the 5-day period or when they seriously fail to meet the promised delivery. The system keeps a lifetime counter per account:
- 1st and 2nd cancellation: email warning, at no financial cost.
- 3rd and subsequent: penalty of 8% of the gross lot price, deducted from your Connect balance.
If the balance does not cover the penalty, payouts are suspended until it is settled. The seller can appeal any penalty by contacting support and providing evidence (force majeure, technical problem, justified off-platform shipping made on time, etc.).
6. Auctions and sale commitments
Starting an auction is a firm declaration of the seller's intention to transfer the product to the winning bidder under the published conditions. Once started, it may only be cancelled for exceptional reasons and with prior authorisation from the Krofter team. Unjustified cancellation of auctions is considered a breach of contract.
7. Shipping policy for sellers
Logistics management runs through envia.com and the integrated carrier network. The seller must weigh and measure the actual package honestly. If the actual dimensions exceed the expected box and shipping becomes more expensive, the buyer must approve the surcharge or open a dispute before the label is generated. Krofter mediates in the event of a dispute.
The seller is not responsible for carrier delays once the label has been correctly generated, but is responsible for tracking and responding to the buyer's queries.
8. Suspension and termination
Krofter may suspend or cancel a seller's account in the following cases:
- Serious or repeated breach of these Terms.
- Unpaid penalties after a reasonable period for settlement.
- Detection of prohibited, counterfeit or illegal products.
- Abusive conduct towards buyers or other sellers.
- Well-founded evidence of fraud, auction manipulation or use of mule accounts.
The suspension does not exempt the seller from fulfilling orders already confirmed or from responding to pending disputes. Withheld amounts may remain blocked for as long as necessary to resolve open disputes and handle potential refunds.
9. Intellectual property of uploaded content
The seller warrants that they own or hold a licence over all the content they upload (text, images, video, brand). They grant Krofter a non-exclusive, worldwide, royalty-free licence for the time needed to host and display the content on the Platform, including its distribution for promotional purposes. This licence ends when the content is deleted or the account is cancelled, except as necessary to keep legal records of the transactions carried out.
10. EU Regulation 2019/1150 (P2B)
In accordance with Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services:
- Substantial changes to these Terms are notified with a minimum notice of 15 days.
- The restriction, suspension or cancellation of a seller's account is justified to the seller in writing, except in the event of detected fraud or an urgent legal request.
- The main parameters of the monthly league ranking are published openly in the Help Centre: 40 % order volume and 60 % amount invoiced, with quality and diversity penalty factors.
- Krofter provides sellers with the internal dispute management system («Disputes» panel) as a free mechanism for handling complaints.
- For alternative dispute resolution, mediation by the Huelva Chamber of Commerce is accepted as a qualified external mediator.
